Terms and Conditions
Pricenow offers the use of an IT system for the sale of ski tickets for selected mountain railways at flexible prices, which depend on various factors such as the booking time and the day of the week. For this purpose, Pricenow operates a purchasing process (hereinafter referred to as the "Booking Process") via various subdomains of the website www.pricenow.ch (for example, but not limited to, the page https://shop.ovronnaz.ch), through which a direct contract conclusion between purchasers and potential purchasers (hereinafter collectively referred to as "Customers") of ski passes from the operator of the respective ski area (hereinafter referred to as "Mountain Railway") is to be enabled.
These General Terms and Conditions for the use of the Booking Process of Pricenow AG (hereinafter referred to as "GTC") apply to all services offered by Pricenow AG (hereinafter referred to as "Pricenow") in connection with the provision of the Booking Process (see Section 2 below). By using these services from Pricenow, the following conditions are accepted unchanged and in full.
The privacy policy listed in the Booking Process is an integral part of these GTC.
For the sake of simplifying readability, terms defined below are partially used in the singular and partially in the plural. For the same reason, the simultaneous use of male and female forms is generally omitted. The corresponding statements thus fundamentally apply to both forms.
The subject matter of these GTC is the use of services that Pricenow offers to Customers within the framework of the Booking Process.
Consent to these GTC is given by using the corresponding services. Whether a contract is actually concluded between Customers or users of the Booking Process and the Mountain Railway is irrelevant. When using individual services from Pricenow, the Customer may be required to reaffirm their consent to the GTC by clicking a corresponding confirmation box.
For all services in connection with the Booking Process, the terms and conditions made accessible by us apply (to be found at https://shop.ovronnaz.ch). Pricenow is entitled to change the service offerings at any time or to restrict or discontinue the provision of services.
Pricenow aims to facilitate the conclusion of contracts between Customers and the Mountain Railway for ski passes. In this regard, Pricenow acts as an intermediary between Customers and the Mountain Railway and is thus neither a contracting party of Customers nor of the Mountain Railway in connection with the purchase of ski passes.
The contract for the purchase of ski passes between Customers and the Mountain Railway is concluded in accordance with the conditions specified by the Mountain Railway (such as purchase price), and, on the other hand, is additionally based on the corresponding GTC of the Mountain Railway.
In order to utilize the main services of Pricenow, namely the purchase of ski passes via the Booking Process, the Customer must identify themselves in the Booking Process with their email address and password (hereinafter referred to as "Access Data"). If the Customer does not yet have a user account, they will be prompted to register in the Booking Process with the required information upon their first use or utilization of the services offered by Pricenow. The Customer is obliged to provide the required information completely and truthfully.
The Access Data communicated to the Customer is intended exclusively for their personal use and must be treated confidentially. All orders placed through the user account will be attributed to the (registered) holder of the corresponding user account and are binding for them.
The overview of available ski passes provided by Pricenow in the Booking Process is merely an invitation to the Customer to submit an offer.
The Customer makes their selection through the Booking Process. By confirming the order, the Customer submits a binding offer to purchase the selected ski pass. The Customer is obliged to provide all required information completely and truthfully when making the offer. After completing the ordering process, the Customer will receive a confirmation of the order via email. This confirmation explicitly does not constitute acceptance of the offer made by the Customer by the Mountain Railway.
The Customer is obliged to promptly verify the accuracy of the order confirmation upon receipt and to immediately notify the Mountain Railway of any discrepancies.
The receipt or provision of ordered ski passes is done according to the Customer's choice, either via corresponding validation on the (1) SwissPass or (2) Keycard of the Customer, or through the (3) print-at-home function.
After payment is received, the Customer will receive either a link via email to retrieve the print-at-home ski pass or the corresponding PDF file, which contains the print-at-home ski pass.
The Customer prints the print-at-home ski pass in unchanged size using a suitable printer on A4-sized white paper. The Customer acknowledges that it is their own responsibility and risk to have all necessary technical equipment required to receive and print the print-at-home ski pass.
The printed print-at-home ski pass must be carefully kept until the corresponding validity date and must not show any damage, dirt, or other impairments that could make its validity check impossible or difficult. If such damage, dirt, or other impairments are present, there is no claim to receive the corresponding Keycard or service provision from the Mountain Railway.
Any reproduction, alteration, or imitation of the print-at-home ski pass and any electronic distribution of the corresponding PDF file is expressly prohibited.
The Mountain Railway may refuse the validation of the print-at-home ski pass on the corresponding Keycard of the Customer if multiple prints, reproductions, copies, or imitations of a print-at-home ski pass are in circulation and a holder of a print, copy, or imitation of the respective print-at-home ski pass has already been granted the corresponding Keycard validation.
The Mountain Railway is expressly entitled, but not obliged, to verify the identity of the user as well as the authenticity of the print-at-home ski pass. Therefore, the Customer is obliged to identify themselves upon request of the Mountain Railway.
The Mountain Railway may refuse the corresponding validation to the user of the print-at-home ski pass if they are unable to sufficiently identify themselves. If validation is denied to a user of a print-at-home ski pass for any of these reasons, there is no claim for a refund of the fee.
Payment is made either by charging the credit card specified during the ordering process or stored in the user profile (Eurocard/MasterCard, Visa, possibly American Express) or other cashless payment tools.
Returns, refunds, and exchanges of purchased ski passes are generally excluded and can only occur in exceptional cases and in accordance with the applicable General Terms and Conditions of the Mountain Railway. The decision on this is made exclusively by the respective Mountain Railway based on its General Terms and Conditions, not by Pricenow. The handling of any returns, refunds, and exchanges is also carried out exclusively by the Mountain Railway and in no case by Pricenow.
Pricenow provides its services carefully and professionally within its operational resources and foreseeable demands, as long as it is not prevented by circumstances beyond its control.
The Customer is aware that Pricenow provides its services via the Internet or using communication networks. Particularly due to technical disturbances, operational disruptions, as well as disruptions or interruptions of communication networks, and due to the failure of IT infrastructures or other parts of the infrastructure required for service provision, there may be temporary impairments or interruptions in the service provision of Pricenow. Therefore, Pricenow does not guarantee the uninterrupted availability and error-free performance of its services.
Furthermore, Pricenow, as an intermediary between the Mountain Railway and the Customer, provides no warranty for the use of the ski pass. All warranties or any exclusions of warranties are governed by the purchase contract between the Customer and the Mountain Railway or the applicable General Terms and Conditions of the respective Mountain Railway.
Pricenow commits to processing personal data solely in accordance with the applicable data protection legislation, particularly the General Data Protection Regulation [GDPR] of the European Union and the Federal Act on Data Protection of June 19, 1992 [DPA]. Pricenow takes appropriate technical and organizational measures to ensure the security of personal data and to prevent unauthorized or unlawful processing. Pricenow protects personal data from accidental loss, alteration, disclosure, or access. However, Pricenow expressly excludes liability for damages resulting from data loss or knowledge and processing of personal data by unauthorized persons. This also applies to damages resulting from the disclosure of personal data to third parties in the context of the respective processing purpose. Further information about the rights of users of Pricenow can be found in the current version of our privacy policy ().
For breaches of its own contractual obligations arising from these General Terms and Conditions, Pricenow is liable to the Customer without limitation for direct and proven damages caused by Pricenow through unlawful intent or gross negligence.
Liability for slight negligence as well as for indirect damages or consequential damages is expressly excluded. Consequential damages include, in particular, lost profits, reputational damage, and data loss resulting from temporary impairments or interruptions in the availability of Pricenow's services, as well as due to failures of distribution channels, transmission errors, untimely delivery or provision of ski passes, incorrect price or service information, and errors in order confirmations.
Any liability of Pricenow for content on third-party websites (especially Mountain Railways) that reference Pricenow's services is also excluded. Pricenow also assumes no liability for references and links to third-party websites. Any responsibility for such websites is rejected. Accessing and using such websites is at the visitor's or Customer's own risk.
Pricenow cannot verify and therefore cannot guarantee whether the Mountain Railway fulfills its performance obligations arising from or in connection with the contract between it and the Customer correctly and completely. For any breaches of contract, only the Mountain Railway is liable and not Pricenow.
All content accessible through the Booking Process from Pricenow (hereinafter referred to as "Content") is protected by copyright and, unless otherwise specified, belongs exclusively and comprehensively to Pricenow. The (complete or partial) reproduction, distribution, transmission (electronically or by other means), modification, linking, or use of the Content for public or commercial purposes is prohibited without prior written consent from Pricenow.
The place of performance for the services of Pricenow, including the provision of ski passes, is the registered office of Pricenow.
Pricenow reserves the right to change these General Terms and Conditions at any time. Changes will be made available in the Booking Process and will take effect upon their posting.
These General Terms and Conditions and any disputes arising from or in connection with the relationship between Pricenow and the Customer are governed exclusively by Swiss law, excluding any conflict of law provisions and the provisions of the UN Convention on Contracts for the International Sale of Goods (CISG). Any disputes related to data protection between Pricenow and the Customer will also be assessed according to Swiss law.
The exclusive jurisdiction for all disputes between Pricenow and the Customer is the registered office of Pricenow.
